1. Acceptance of Terms

By creating an account on Swap, you agree to be bound by these Terms of Service and all applicable laws and regulations in Nigeria.

If you do not agree with any of these terms, you are prohibited from using or accessing this app. The materials contained in this app are protected by applicable copyright and trademark law.

2. Eligibility and Account

• You must be at least 18 years old to use Swap.

• You are responsible for maintaining the confidentiality of your account password and for all activities that occur under your account.

• You must provide accurate and complete information during the KYC (Know Your Customer) process. Failure to do so may lead to account suspension.

3. Trading and Transactions

3.1 Crypto & Gift Card Trades

• All trades are final. Once a crypto transaction is confirmed on the blockchain or a gift card code is submitted and verified, it cannot be reversed.

• Swap reserves the right to reject any gift card that is found to be already used, invalid, or obtained through fraudulent means.

3.2 Rates and Fees

• Exchange rates for crypto and gift cards fluctuate based on market conditions. The rate displayed at the time of your transaction is the rate that will be applied.

• We clearly display any service fees before you finalize a swap or withdrawal.

4. Wallet and Funding

• Swap provides users with a wallet address to receive digital assets. You are responsible for ensuring you send the correct asset to the correct network address.

• Sending the wrong token to a wallet (e.g., sending BTC to an ETH address) may result in the permanent loss of those funds. Swap is not liable for user errors in fund transfers.

5. Withdrawals to Nigerian Bank Accounts

• Withdrawals are processed to the Nigerian bank account linked to your profile.

• While we aim for instant processing, delays may occur due to third-party banking network issues or maintenance. Swap is not responsible for delays caused by your local bank.

6. Prohibited Activities

You agree not to use Swap for:

• Money laundering, terrorism financing, or any illegal financial activity.

• Selling gift cards obtained through scams or unauthorized means.

• Attempting to hack, decompile, or disrupt the app’s infrastructure.

• Multiple account creation to bypass trading limits.

7. Account Suspension and Termination

We reserve the right to suspend or terminate your account at our sole discretion, without notice, if we suspect a violation of these terms or any suspicious fraudulent activity.

In cases of suspected fraud, funds in the account may be held until an investigation is completed or as required by law enforcement.

8. Limitation of Liability

Swap and its suppliers shall not be held liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption) arising out of the use or inability to use the platform.

We do not guarantee that the service will be uninterrupted or error-free at all times.

9. Governing Law

These terms and conditions are governed by and construed in accordance with the laws of the Federal Republic of Nigeria, and you irrevocably submit to the exclusive jurisdiction of the courts in that location.
